Introduction

At Forly, we recognize our obligations under various European Union regulations, not limited to the GDPR, and we aim to uphold best practices in consumer protection, e-commerce, and digital services. This EU Policy outlines our approach to key EU rules affecting our product offerings and online interactions with users across the European Union.

Scope

This EU Policy applies to Forly’s operations, where we provide services and digital content to EU-based users or engage in activities that fall under EU regulations. It is intended to supplement our Privacy Policy, GDPR Policy, and other internal policies concerning data processing and consumer rights.

Compliance with Key EU Directives & Regulations

  1. E-Commerce Directive (2000/31/EC)

    • We ensure transparency of our company details (legal name, address, registration info) on our website and app.

    • We provide clear terms of service and contact information so users can easily reach us with queries or complaints.

  2. Consumer Rights Directive (2011/83/EU)

    • We give consumers clear information about prices, features, and refund/cancellation rights before they purchase any services or content through Forly.

    • We offer a 14-day “cooling-off” period for eligible digital purchases, subject to certain exceptions (e.g., digital downloads already accessed).

  3. Unfair Commercial Practices Directive (2005/29/EC)

    • We do not engage in misleading, aggressive, or otherwise unfair marketing practices.

    • We clearly label advertisements and promotional content within the Forly ecosystem.

  4. Geo-Blocking Regulation (2018/302)

    • We do not unjustifiably block access to our services or re-route EU consumers based on their nationality or place of residence.

    • We offer the same conditions of access and pricing to consumers in all EU member states, unless otherwise justified by objective criteria (e.g., VAT differences).

  5. Online Dispute Resolution (EU Regulation No. 524/2013)

    • We inform EU consumers of their right to seek resolution of disputes via the EU’s Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

  6. Cookie and e-Privacy Requirements

    • We comply with the e-Privacy Directive (2002/58/EC) and its national implementations.

    • Where required, we obtain user consent for non-essential cookies or similar tracking technologies and provide a mechanism to opt in or out.

Children’s Data and Age-Appropriate Design

  • In line with the Children’s Code (Age-Appropriate Design Code) and relevant EU guidelines, we take a high-privacy and safety-first approach when offering services to children.

  • We only collect minimal personal data from children and require parental or guardian consent for certain activities.

User Rights & Redress

  • Right to Information and Transparency: We inform users about the key features, pricing, and any applicable terms before they commit to purchases.

  • Right to Cancel: EU consumers generally have a right to cancel digital service contracts within 14 days of purchase unless they have explicitly agreed to immediate performance of the contract (e.g., downloading a story or audio content).

  • Right to Complain: Users can contact us directly at hello@forlygroup.com if they have concerns. If they remain dissatisfied, they can explore the ODR platform or local consumer authorities.
